1. Definitions

In these Terms and Conditions:

  • "We," "Us," "Our" refers to Amberveil, a watch repair service operating in George Town, Penang, Malaysia.
  • "You," "Your," "Client" refers to the person or entity using our services.
  • "Services" refers to watch repair, maintenance, and consultation services we provide.
  • "Timepiece" refers to any watch or clock brought to us for service.
  • "Agreement" refers to these Terms and Conditions plus any service estimates or work orders.

2. Acceptance of Terms

By using our website, contacting us, or bringing a timepiece to our workshop for service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

You must be at least 18 years old to enter into this agreement. By using our services, you confirm that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Service Description

We provide the following services:

  • Date mechanism repair for mechanical watches
  • Haute horlogerie service for prestige timepieces
  • Watch storage guidance consultations
  • Other related watch repair and maintenance services as agreed

All services are provided at our workshop located at 19 Jalan Dhoby, 10200 George Town, Penang, Malaysia. Service availability is subject to our workshop hours and capacity.

4. Service Process

4.1 Initial Assessment: We will examine your timepiece and provide an estimate of required work, timeline, and cost before beginning any service.

4.2 Authorization: Work will not commence without your explicit approval of the estimate.

4.3 Additional Work: If we discover additional issues during service, we will contact you for authorization before proceeding with work beyond the original estimate.

4.4 Timeline: Estimated timelines are approximate. While we strive to meet these estimates, actual completion times may vary due to parts availability, complexity of work, or unforeseen issues.

5. Payment Terms

5.1 Pricing: All prices are stated in Malaysian Ringgit (MYR) and are current at the time of estimate.

5.2 Payment Due: Full payment is due upon collection of your timepiece unless alternative arrangements have been made in writing.

5.3 Accepted Methods: We accept cash and bank transfer. Other payment methods may be available upon inquiry.

5.4 Non-Payment: We reserve the right to retain your timepiece until payment is received in full. Storage fees may apply after 30 days from service completion notification.

6. Warranty

6.1 Service Warranty: Our work carries a six-month warranty from the date of service completion, covering the specific repair or service performed.

6.2 Warranty Exclusions: The warranty does not cover:

  • Damage from accidents, misuse, or improper handling after service
  • Water damage if water resistance was not part of the service
  • Normal wear and tear
  • Issues unrelated to the performed service
  • Timepieces serviced by others after our work

6.3 Warranty Claims: To make a warranty claim, contact us within the warranty period with details of the issue. We will assess the claim and repair or replace affected work at our discretion.

7. Limitation of Liability

While we exercise appropriate care in handling timepieces, watch repair inherently involves some risk. To the fullest extent permitted by Malaysian law:

7.1 Our liability for any loss or damage to your timepiece is limited to the documented value you provide upon drop-off or the service fee paid, whichever is lower.

7.2 We are not liable for any indirect, consequential, or special damages including loss of use, sentimental value, or opportunity costs.

7.3 We recommend obtaining appropriate insurance for high-value timepieces.

7.4 Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud, or matters that cannot be excluded under Malaysian law.

8. Your Responsibilities

You agree to:

  • Provide accurate information about your timepiece and its condition
  • Disclose any previous repair attempts or known issues
  • Declare the value of your timepiece for insurance purposes
  • Collect your timepiece within 30 days of completion notification
  • Pay all agreed fees promptly
  • Follow any care instructions or recommendations we provide

9. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Amberveil or our licensors and is protected by Malaysian and international copyright laws.

You may not reproduce, distribute, or create derivative works from our website content without written permission.

10. Termination

10.1 By You: You may cancel a service request before work begins with no penalty. Deposits, if any, will be refunded.

10.2 By Us: We reserve the right to refuse service if we believe we are not the appropriate service provider for your timepiece or if we cannot meet your requirements.

10.3 Effect: Upon termination, you must collect your timepiece and pay for any work completed up to that point.

11. Dispute Resolution

11.1 Governing Law: These terms are governed by the laws of Malaysia.

11.2 Jurisdiction: Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Penang, Malaysia.

11.3 Informal Resolution: Before initiating formal proceedings, we encourage you to contact us to attempt informal resolution of any disputes.

12. General Provisions

12.1 Entire Agreement: These terms, together with any service estimates or work orders, constitute the entire agreement between you and Amberveil.

12.2 Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.

12.3 Waiver: Our failure to enforce any right does not constitute a waiver of that right.

12.4 Assignment: You may not assign your rights under this agreement without our written consent.

13. Changes to Terms

We may update these Terms and Conditions from time to time. Changes will be posted on our website with a new "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the revised terms. We recommend reviewing these terms periodically.
